These terms govern your use of this website. By using the site, joining the waitlist or signing up to our newsletter, you agree to them. If you do not agree, please do not use the site.

1. Who we are

This site is operated by Fifth Performance Ltd, a company registered in England and Wales (company number 16886151) with its registered office at 11 Railway Side, London SW13 0PN. "We", "us" and "our" refer to that company.

2. What this site is

The Fifth is a members' club planned to open in London. This website is an informational and pre-registration site. It does not sell anything, and nothing on it is an offer of membership. The facilities, membership tiers and pricing described are indicative of our plans and may change before opening.

3. Joining the waitlist

You may register your interest by joining the waitlist. Doing so:

• does not create a membership, a contract, or any obligation on either of us;
• does not reserve a place, guarantee you will be offered membership, or guarantee any particular price or opening date;
• costs nothing, and you may ask us to remove you at any time.

We may contact you about your registration and about the club opening. If you ticked the optional marketing box, we may also send you marketing — you can withdraw that at any time, and every marketing email includes an unsubscribe link. How we handle your details is set out in our Privacy Policy.

4. Newsletter

You may subscribe to our newsletter with your email address. You can unsubscribe at any time using the link in any email we send.

5. The high-performer tax calculator

The calculator is provided for general interest only. It produces an indicative estimate based on the figures you enter and assumptions we have chosen. It is not financial, tax or professional advice, and you should not rely on it when making decisions. The figures you enter are stored anonymously for our own research, as described in our Privacy Policy.

6. Acceptable use

You agree not to:

• submit false details, or register someone else's details without their permission;
• use the site's forms to send unsolicited, abusive or unlawful content;
• attempt to gain unauthorised access to the site or any system behind it, or to disrupt it — including by automated or high-volume requests;
• copy, scrape or reuse the site's content other than as permitted below.

We may restrict or refuse access to anyone who does not follow these rules.

7. Our content

All text, images, branding and design on this site belong to us or our licensors, and are protected by copyright and trade mark law. You may view and share pages for your own personal, non-commercial use. Any other use needs our written permission.

8. Availability and accuracy

We aim to keep the site available and its information accurate, but we do not guarantee either. We may change, suspend or withdraw any part of the site at any time, and details of the club — including facilities, tiers, pricing and opening date — may change.

9. Liability

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited.

Subject to that, we are not liable for any loss arising from your use of this site or from reliance on its content, including the calculator's estimates. If you are using the site in the course of a business, we are not liable for loss of profit, business, goodwill or opportunity.

10. Changes to these terms

We may update these terms from time to time. We'll update the "last updated" date at the top of this page when we do, and the version shown here is the one that applies.

11. Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute arising from them.
