Privacy Policy

The Fifth ("we", "us", "our") respects your privacy and is committed to protecting your personal data. This policy explains what data we collect, why we collect it, and the choices and rights you have around it.

1. Who we are

The Fifth is a members' club based in London, United Kingdom, operated by Fifth Performance Ltd, a company registered in England and Wales (company number 16886151) with its registered office at 11 Railway Side, London SW13 0PN.

For the purposes of UK data protection law, Fifth Performance Ltd is the "data controller" of the personal data described in this policy.

2. What data we collect

We collect personal data in a small number of places on this site:

• Waitlist registrations — when you join the waitlist we collect your first and last name, email address, company name, LinkedIn handle, and the membership you are interested in. We also record whether you ticked the optional box agreeing to receive other communications from us, along with the wording you agreed to and the date you agreed.
• Newsletter sign-up — when you sign up to "stay in the loop", we collect your email address so we can send you updates about The Fifth.
• High-performer tax calculator — the figures you enter into the calculator (spend and travel time) are stored anonymously for our own market research. We do not collect your name, email, or any other identifying information as part of this tool, and the results are not linked to any waitlist registration or newsletter sign-up you may separately make.

3. How and why we use your data

We use the data described above to:

• register your interest, keep you on the waitlist, and contact you about your registration and the opening of the club;
• send you marketing about The Fifth, where you have agreed to receive it;
• send you the newsletter updates you've signed up to receive;
• understand, in aggregate, how visitors think about their existing spend on fitness, workspace and club memberships, so we can improve The Fifth's offering.

Our legal basis for this processing is:

• Consent — for sending you marketing, including the newsletter and any marketing sent to waitlist registrants who ticked the optional box. You can withdraw consent at any time (see "Your rights" below), and withdrawing it will not remove you from the waitlist.
• Legitimate interests — for administering the waitlist itself and replying to you about your registration, and for the anonymised market research collected via the tax calculator.

4. Who we share your data with

We use third-party service providers to run this site and to store and process the data described above. These providers act as our data processors — they only process data on our instructions and are not permitted to use it for their own purposes. We do not sell your personal data to anyone.

They currently are:

• Tiquo — our membership and customer management platform. Waitlist registrations and newsletter sign-ups are stored here, and the emails we send you about your registration and about The Fifth are sent through it.
• HubSpot — previously used for newsletter sign-ups. We no longer send it new data, but it still holds records collected before September 2026.
• Supabase — database hosting for the anonymous tax calculator figures.
• Vercel — website hosting. Data you submit passes through Vercel's infrastructure in transit.

5. Transfers outside the UK

Some of the providers above process data outside the United Kingdom. Where that happens, we rely on the safeguards permitted by UK data protection law — either the country being covered by UK adequacy regulations, or contractual protections such as the UK International Data Transfer Agreement or Addendum. You can ask us for more detail about the safeguards that apply using the contact details below.

6. How long we keep your data

We keep waitlist registration data for as long as reasonably necessary to run the waitlist and, if you go on to become a member, for the duration of your membership plus a reasonable period afterwards for our legal and accounting obligations. If the club does not open, or you ask us to remove you, we will delete it. We keep newsletter sign-up data until you unsubscribe. Tax calculator submissions are anonymous and are kept for aggregate market research purposes.

7. Your rights

Under UK data protection law, you have the right to:

• ask us for a copy of the personal data we hold about you;
• ask us to correct any data that is inaccurate or incomplete;
• ask us to delete your data;
• ask us to restrict how we use your data;
• ask us to move your data to another organisation;
• object to us processing your data, including for direct marketing;
• withdraw your consent at any time, where we rely on consent. Every marketing email we send includes an unsubscribe link, and you can also ask us directly using the contact details below. Withdrawing consent does not affect anything we did before you withdrew it, and does not remove you from the waitlist.

To exercise any of these rights, contact us using the details below. You also have the right to complain to the UK's data protection regulator, the Information Commissioner's Office (ICO), at ico.org.uk.

8. Cookies and local storage

This site does not use advertising cookies or third-party analytics trackers, and we do not track you across other websites.

The waitlist form is powered by Tiquo, whose software stores a small amount of information in your browser's local and session storage so the form can work. This is strictly necessary to provide the service you asked for and is not used to profile or track you. Tiquo's optional website analytics is switched off. If that changes — for example if we add analytics in future — we will update this policy and ask for your consent first.

9. Children

The Fifth is a service intended for adults. We do not knowingly collect personal data from children.

10. Changes to this policy

We may update this policy from time to time. We'll update the "last updated" date at the top of this page when we do.
